The Supremes have ruled. Mostly 6-3. When in favor of conservative ideology and the current Administration, 6-3. When in favor of not overturning policies from previous Administrations, 6-3. The most consequential procedural ruling limits the courts’ ability to grant nation-wide injunctions. Class action lawsuits are still available. The case happened to be about birthright citizenship.
There is the rule, the law, the rule of law, and that which is wielded by the rulers. Mostly this is etched slowly over time, moderately, deliberately, until it is not. And when it is not, the rule, the law, and the rule of law cannot be counted on to moderate or force deliberation. Thus, it is possible for rulers to move along the action spectrum called “overreach”, to be defined by the many peoples who arise to move along the action spectrum. Overreach is best understood in its actual manifestation rather than predictive debate.
